This privacy policy (the “Privacy Policy”) describes the types of personal information Portworx, Inc. (“Portworx,” “we”, “us”, and “our”) may collect from you or that you may provide to us through Portworx websites, PX-Central customer and users site (“Portal”), products and services. Portworx knows that you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By visiting portworx.com and other Portworx sites (the “Sites”) and customer portals that include a link to our Privacy Policy, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

For the purposes of the EU General Data Protection Regulation 2016 (the “GDPR”) the data controller is Portworx, Inc. whose registered office is at 4940 El Camino Real, Suite 200, Los Altos, CA 94022.

What Information Do We Collect?

Sites. We collect personal information you provide to us when you visit our Sites, request a demo, are a user of our products and services, request for support, subscribe to our newsletter or blog, respond to a survey, fill out a form, register for an event or webinar, or otherwise communicate with us or meet with us in person. The information you give us may include your name, company name, employer, position, address, e-mail address, phone number, username and password or areas of interest.
Our web servers collect technical information relating to visitors to our Site, including the Internet protocol (IP) address used to connect your computer to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform. We also collect information about your visit, including pages you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number. This information may be aggregated to measure the number of visits, average time spent on a Site, pages viewed, etc. We use this information to measure the use of our Site and to improve the content we offer. We may share anonymized experiential information or other data with third parties on an aggregated basis without the use of any information that personally identifies you. We will combine this information with information you give to us and information we collect about you. We will use this information and the combined personal information for purposes set out in this Privacy Policy (depending on the types of information we receive).
Portal. We collect any information that you submit to us voluntarily through the Portal or provide to us in any other way. For example, when you register for an account on the Portal, you will be required to provide us with contact information, such as your name, company name, email address, and/or phone number, as well as your username and password. You can also register for an account using a different credential such as your Google or GitHub login. If you do so, you authorize us to access certain information from that account (based on your privacy settings within that account), such as your name, company name, email address, and/or phone number.
We collect certain information when you visit and access our Portal. This includes your device type, browser type, operating system, browser plug-ins, language settings, cookie preferences, different actions you perform, request support, the IP address you used to access the customer portal and geolocation data to understand where visitors reside.
We use Google Analytics software to help us better understand how visitors use our Portal. The Google Analytics software collects non-personally identifying information, including browser type, referring domains, and page views. We may use other analytic services as well or in lieu of Google Analytics software.
Career Site. We may collect personal information when you visit and use our careers site, portworx.com/careers, to learn about us and apply for open positions by submitting a resume and other information via email. We may also receive resumes from recruitment consultants, Portworx employees or other third parties. Resumes will typically include personal information, including name, contact details, information about academic and professional qualifications and experiences, your interests and the position at Portworx for which you are applying.
Third Parties. We may receive your personal information from event organizers, partner companies, or 3rd party data providers when you have given your consent.

Our Use of Collected Information

Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the information requested or as set out in this Privacy Policy or as otherwise described when you provide your information. We will only process your personal information, including sharing it with third parties, for a purpose described in this Privacy Policy, where (1) you have provided your consent which can be withdrawn at any time, (2) the processing is necessary for the performance of a contract we are about to enter into or have entered into with you, (3) we are required by law, (4) processing is required to protect your vital interests or those of another person, or (5) processing is necessary for the purposes of our legitimate commercial interests, except where such interests are overridden by your rights and interests.
We will process your personal information for the following purposes in line with our legitimate commercial interests:
  • To provide you with information about other goods and services we offer that are similar to those that you have already purchased, provided you have not opted-out of receiving that information
  • To notify you about changes to our Site, Portal or other services
  • To detect and prevent fraud or other financial crime
  • To monitor and protect the security of our information, systems and network
  • For internal business intelligence purposes, product development and enhancement
  • To respond to your questions and provide related customer services
  • To ensure that content from our Sites and/or Portal is presented most effectively for you and your computer or mobile device.

Sharing of Collected Information

We do not sell, trade, or otherwise transfer your personally identifiable information to outside parties without your consent. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. However, non-personally identifiable Site visitor information may be provided to other parties for marketing, advertising, or other uses.
We may share your information with service providers, vendors or agents working on our behalf. For example, companies we've hired to provide analytics, training, support or assist in protecting and securing our systems and services may need access to your information in order to provide those functions. These providers work on our behalf and agree not to use or disclose information we provide for purposes other than providing their services.
We may share aggregated and anonymous information that we collect from you and other visitors to our Portal with service providers and partners in order to provide or improve the Portal, and our products and services. This information does not identify you and we require our partners to keep all such information in its anonymous form.
Legal Disclosure and Business Transfers. We may disclose any information we collect without notice or consent from you, if we believe in good faith that the disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or other crimes, or respond to lawful government requests. In such instances, we will limit disclosure to that information which is necessary to accomplish the above purposes. We also reserve the right to disclose or transfer the information we collect to another company in connection with a corporate sale, merger, reorganization, dissolution or similar event (a “Corporate Transaction”). We will endeavor to provide you with notice (via a posting to our website or such other method that we deem appropriate) of any such Corporate Transaction. Do We Use Cookies?

Yes. Like most websites, we use cookies to understand and save your preferences for future visits, compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. When you visit our Portal, we may collect information from you automatically through cookies or similar technology. For example, we may employ cookies to help us recognize you when you move from page to page within our Portal. “Do Not Track” Signals

“Do Not Track” is a web browser setting that requests that a web application disable its tracking of an individual user. However, as an industry-standard protocol for Do Not Track signals has not yet been established, we do not disable tracking technology that may be active on our Sites or the Portal in response to any Do Not Track requests that we receive from your browser or device. If you arrive at our Site by way of a link from a third-party site that does respond to Do Not Track requests, the recognition of any Do Not Track request you have initiated will end as soon as you reach our Site.

How Do We Secure Your Information?

We endeavor to safeguard personal information to ensure that such information is kept private by maintaining appropriate administrative, technical and physical security measures. However, the inherent insecurity of the Internet and other factors, may compromise the security of your personal information at any time. Therefore, we cannot guarantee the security of your personal information.

How Do We Manage Email Communications?

Sites. If you decide to opt-in to our mailing list, you will receive emails that may include company news, updates, surveys, and related product or service information. If at any time you would like to unsubscribe from receiving future emails, we include an unsubscribe link at the bottom of each email and on our website. You can also contact us on the details above. However, there are certain emails that we may continue to send per your request or that are necessary for you to receive the full benefit of the company services. For example, we may contact you by mail, telephone, email or other electronic messaging service with information that may be of interest to you about our products and services.
As a Prospect or Customer. We may contact you by mail, telephone, email or other electronic messaging service with information that may be of interest to you about our products and services. Portworx uses email to deliver information that registered users request as well as provide details about customer account(s), delivery information, and operational information regarding existing products, services and systems. By providing us with your telephone number, email or mailing address you consent to being contacted by these methods for these purposes. If you do not wish to receive such information from us, please contact us at privacy@portworx.com. Additionally, you can opt-out of receiving certain email communications from us, by adjusting your account settings or following the unsubscribe instructions provided in the message we send to you. If you opt-out, we may still send you non-marketing communications including emails about the Portal, technical support services, and our business dealings with you.

How Long Do We Store Your Personal Information?

We will store your personal information, in a form which permits us to identify you, for no longer than is necessary for the purpose for which the personal information is processed. We may retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and rights, or if it is not technically reasonably feasible to remove it. Consistent with these requirements, we will try to delete your personal information quickly upon request.
Certain information, such as your registration profile can be reviewed and updated through the controls available within your account. Please note that due to the way we maintain our servers, after your information is deleted, backup or residual copies may exist for some time before they are completely deleted from our servers.

Children and Privacy

Our Sites and customer portals are not directed to persons under the age of 13 and we do not knowingly collect or solicit personal information from persons under the age of 13. If you are a parent or legal guardian who discovers that your child has provided us with any personal information, you may contact us at any time at privacy@portworx.com, and we will take the appropriate steps to delete this information from our files and records.

Transfer of Personal Information Outside of the European Economic Area (“EEA”) and International Users

We are headquartered in the United States. Your personal information may be accessed by us or transferred to us in the United States or to our affiliates, partners, or service providers who are located worldwide. If you are visiting our Site or Portal from outside the United States, be aware that your information may be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated. By accessing, using or providing personal information through our Sites and Portal, you consent to any transfer of this information subject to applicable law.

This Privacy Policy applies only to the Sites and Portal. It does not apply to any third party websites, applications, and/or services that may be linked to, facilitated through, or provided via our Sites or Portal. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites, including their use of any cookies and/or collection of any personal information. We encourage you to be aware when you leave the Sites and/or Portal, and to read the privacy policy of each website that you visit.

Changes to This Privacy Policy

We may update or revise this Privacy Policy from time to time. We will notify you of changes by posting a revised Privacy Policy to our Sites and Portal, and where appropriate, notify you by e-mail. Your continued use of our Sites and/or Portal following a posting of a revised Privacy Policy constitutes your acknowledgement of the changes and your agreement to the Privacy Policy as revised.
